In 1994, Congress passed the <a href=\"https:\/\/www.justice.gov\/usao-cdca\/domestic-violence-laws\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #1155cc;\">Violence Against Women Act (&#8220;VAWA&#8221;).<\/span><\/a> This Act, and the 1996 additions to the Act, recognize that domestic violence is a national crime. Forms of <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/domestic-violence.html\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #1155cc;\">domestic violence <\/span><\/a>include, but are not necessarily limited to the following:<\/p><ul><li>Physical abuse &#8211; examples include \u200b\u200bhitting, biting, slapping, shoving, punching, or strangling, or anything else that causes physical harm<\/li><li>Sexual abuse &#8211; forced, or an attempt to force non-consensual sexual contact or behavior<\/li><li>Emotional abuse &#8211; degrading verbal attacks or criticism to lower the victim&#8217;s self-esteem<\/li><li>Economic\/financial abuse &#8211; abuser controls household finances in a way that makes the victim financially dependent on the abuser<\/li><li>Psychological abuse &#8211; abuser causes the victim to fear them whether it be through threats of harm to the victim or other family members<\/li><\/ul><p><strong>Misdemeanor Vs. Felony Domestic Violence\u00a0<\/strong><\/p><p>California Penal Code 273.5 says, <em>\u201cany person who willfully inflict corporal injury resulting in a traumatic condition\u201d <\/em>on a current or former intimate partner can be charged with <a href=\"https:\/\/strongestdefense.com\/domestic-violence\/misdemeanor\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #1155cc;\">domestic violence.<\/span><\/a> <span style=\"color: #222222;\">Whether or not it will be charged as a misdemeanor or felony is mainly based on the specific circumstances.<\/span><\/p><p><span style=\"color: #222222;\">In any situation, a misdemeanor is considered a <\/span><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #1155cc;\">less serious<\/span><\/a><span style=\"color: #222222;\"> crime than a felony. The biggest difference between a misdemeanor and felony domestic violence charge is the intent and time served. The purpose of the law was to significantly increase the prison sentences of those convicted of felonies who\u2019ve been previously convicted of a violent or serious felony.
