What Can Happen When You Get A DUI

Driving under the influence is a crime that the state of California takes very seriously. The short and long-term implications of driving drunk can be severe. Some of the consequences include, but are not limited to, the following:

  • Jail time or work release
  • Probation
  • Loss of your driver’s license
  • Mandatory attendance of the Drinking Driver Program (alcohol school)
  • Increased insurance costs
  • Impeded ability to maintain your employment (or find new employment) and provide for your family
  • A “prior” record for purposes of subsequent DUI convictions.
These consequences could cause you to lose your job, which in turn can keep you from being able to pay your bills, and may even lead to the need to move somewhere else. You may also have difficulty finding a new job, and your personal relationships might be damaged as well.

The Difference Between A Misdemeanor & A Felony DUI

Misdemeanor and felony DUIs are both serious offenses, but there are some differentiating factors between the two, including the following:

Misdemeanor Felony
  • You will likely be charged with misdemeanor DUI for each of your first 3 offenses in ten years (provided that none involve accidents resulting in severe injury or death).
  • Minimum penalties increase with each offense.
  • If it’s your first-time being charged with a DUI, you could spend 48 hours in jail.
  • If it’s your second DUI offense, you’ll likely face 30 to 60 days in jail.
  • If it’s your third DUI offense, you’ll usually face up to around 180 days.
  • If you caused an accident that resulted in death or serious bodily injury to somebody other than yourself, you will be facing felony DUI charges.
  • If you have three DUI convictions below ten years old, any subsequent DUI will likely be charged as a felony.
  • If you have a previous felony DUI conviction, then any subsequent DUI within ten years will also likely be charged as a felony.
